Man Who Raped Woman And Then Asked Her Out On A Date, Acquitted Of All Charges.

Timothy West was acquitted yesterday of raping a Queens woman he later contacted by text. The jury "didn't believe her story because there were no signs of forced entry" into her home, said one male panelist.

A convict busted after he texted the woman he was accused of raping to ask her for a date was acquitted of all charges yesterday.

Timothy West, 26, embraced his lawyer, Mihea Kim, as jurors found him not guilty in Queens Supreme Court of four counts of rape, predatory sexual assault, burglary and robbery.

An irate Judge Richard Buchter snapped at them, "Cut that out. It's not appropriate in the courtroom."

The surprising verdict -- which the jury reached in less than a day -- came after Pamela Arias testified in horrifying detail that West terrorized her for more than three hours and then apologized and asked her out.

Arias was not in the courtroom yesterday and was unaware of the verdict for several hours.

Her mother said last night, "I can't believe it. I can't believe it. What happened with all the proof? It's crazy to let him walk because of that one detail."

The mom said the reason there was no forced entry was because she had left a window unlocked.

The not-guilty vote came despite the panel's listening to a taped phone conversation in which Arias accused West of raping her, and he apologized.

Although acquitted, West wasn't able to walk out of the courtroom a free man.

He was immediately put on a bus headed back to prison to complete a seven-year sentence for burglary in a different case.

That provides no consolation to Arias, who has been in therapy.

"She's going to school, but it's hard because she's always nervous someone is following her," the mom said.

West had been accused of breaking into Arias' home in Ozone Park at about 1 a.m. March 20, 2009.

The gutsy waitress last week testified that West, whom she had never seen before, entered through a kitchen window, grabbed a butcher knife and walked up the stairs to her bedroom.

She said she didn't scream because she feared what West would do to her brother and mother, who were sleeping down the hall.

She claimed that as her ordeal was ending, West asked her if "maybe we could still be friends."
Arias, 21, agreed only to his request for her cellphone number in the hope that it would lead to his arrest, she testified.

Cops were with her later that day when she got a text from an unknown number that said, "call me."

When she called, three detectives listened in.

"I've never seen you before, and you just walk up to my house . . . and you raped me!" said Arias, according to the recording of the call. West said he was sorry.

They arranged to meet at a doughnut shop and cops busted him there. NyPost

This is not a man, he's a little boy. I hope his ass get's raped if he ever goes to jail so he can get a taste of his own medicine. SMH.

What a shame on the panel of Jurist who sat on the case, are you not really all paying any attention in court listening to all the evidence presented, a Bunch of A*******, DUESHE BAGS, and SCUM BAGS just like Kanye West's song which I hated to hear anyone saying these words on the air waves but now it fits appropiately for these set of Jurist on this case, lol LAUGHING OUT LOUD.

This is horrible. Based on the evidence presented here, I would have found him guilty. Did they not hear the audiotape?

Unfortunately there are all types of rapists, but many have one vision of what a rapist is like. Contrary to what some believe, rape is not about sexual attraction. It is more about what the rapist just wants to do and how they twist reality to suit their desires. That desire is usually to dominate and gain power over their victim.

There are some rapists that try to kill you if you scream and carry on while there are others that will run away. It is difficult to know what situation a person might be in. Ms. Arias is lucky to be alive and to know who her perpetrator is. I will pray for Ms. Arias.

Some perps think they are doing their victim a favor. Others actively want to destroy women. In this case, this creep may have felt he was in a relationship with her. While she was minding her business reading at the library, he may have thought, "We like the same subjects it must be a match"? When he followed her to the coffee shop, he probably smelled her perfume and thought, "Look at her trying to tease me with my favorite scent." When she went home, the tool may have thought, "the stage is set; I know she wants it but she doesn't want to seem like she wants it. I'll just threaten her with a knife to make everything easy." All the while, he never introduced himself to her or she even knew she was being noticied let alone followed.

There are some real sickos out there and the prosecution should have had an expert to explain the type of rapist this defendant most likely was. It seems silly to have to explain the different types of rape especially when you have evidence, but there are people out there that rather believe it was just a misunderstanding.

I have a strong feeling that this unfortunately will not be his last attempt on a woman. For all we know, the burgalries may have started his fantasy of taking whatever he wanted. OR he was hoping to rape some woman but could only find stuff to steal. Either way Ladies and Gentlemen try to remember his face; warn others and be wary.

Because there obviously more to the story but outrageous either way TOO MUCH WOMAN OUT HERE ALL DIFFERENT SHAPES AND SIZES YOU DON'T HAVE TO RAPE YOU CAN AT LEAST GET ONE!!!!
